General Terms and Conditions

1. Scope

These terms and conditions (hereinafter “GTC”) of the excite online shops (hereinafter “excite”) apply to all services and products (hereinafter “products”) of excite. A customer is is any natural or legal person, which maintains a business relationship with excite.

Conflicting or deviating terms and conditions of the customer are not accepted, unless excite has explicitly agreed to their validity in writing. The current and binding version of the GTC is published on this website.

2. Price

All prices are inclusive of VAT, unless otherwise stated.

3. Availability

excite is committed to report the stock availability details thoroughly and as correctly as possible. In particular due to production or supply shortages there may be delay in delivery. All information on delivery times are therefore without guarantee and can change at any time without notice. In case of impossibility of delivery the resolutory condition shall enter into force in accordance with Section 4 of the Terms.

4. Contract Conclusion

The contract takes effect as soon the customer places the order through the online store, at our physical store, by phone or E-Mail. The receipt of an online order, phone or E-Mail order is notified to customer by means of an automatically generated order confirmation to the specified E-Mail address. The receipt of the automatically generated order confirmation does not promise that the product is actually available or can be delivered. It shows the customer only an indication that the given order has been received at excite and thus the contract has been concluded.

If a delivery is not possible in accordance with section 3 of the GTC, the contract is terminated immediately and the customer is informed immediately. If the customer has already paid the products, the amount will be refunded immediately. As a result of such termination excite is not obliged to any replacement.

5. Terms of Payment

The customer agrees to pay for the products with the payment options provided by excite. The current payment options and the corresponding conditions are published in the online shop of excite. excite reserves the right to exclude customers of individual payment options without giving reasons.

Until full payment of the purchase price, the products remain in the ownership of excite.

6. Delay of Payment

If the customer fails to fully or partially adhere to its payment obligations, all outstanding amounts for which the customer owes excite are due immediatley and excite may request these immediately and suspend further deliveries. In case of an order with advance bank payment, excite reserves the right – at the earliest of eight calendar days – and after a reminder has been sent, to terminate all affected contracts without further notice.

7. Termination of Contract

In accordance with section 4 of the GTC, orders are binding and the customer is obliged to accept the goods delivery. Any subsequent changes requested by the customer, that are made after the order are possible in exceptional cases and only at the sole discretion of excite. The possibility of cancellation depends on the product and the timing of cancellation. An order can therefore be cancelled for free, with a handling charge or not canceled at all.

If the customer does not accept the goods within two weeks, despite his obligation, excite can terminate the contract (cancel) and charge for handling fees. In case of delay in delivery of excite accordance with section 4 of the GTC, the customer has the right to withdraw, only after 30 calendar days have passed the agreed delivery date. In that case excite will refund the advance payments made by the customer immediately.

8. Shipping Costs

Delivery costs are shown separately in the order basket and on the invoice. Deliveries, which are classified as bulky goods or goods on pallets are possible and can be requested via customer service.

9. Inspection of Goods

The customer must check delivered or collected items immediately for accuracy, completeness and intactness. Any defects shall be notified to excite immediately after detection, but no later than 5 calendar days of receipt of the shipment or collection. The customer shall keep the product in delivery state and shall not operate it.

10. Exchange & Return

excite products can be exchanged or returned under the following conditions and without cause within 14 days from receipt of goods.

• The product must be unused.
• The product must be in original packaging.
• The accessories supplied must be complete.

The goods will be exchanged or returned in accordance with the three points above. The return shipment is at the customer’s risk and expense. The customer must ensure that the return is sufficiently stamped.

Returns need always to be declared in the customer acoount under “Goods Return”. For orders that have been placed with a guest account, the return must be requested to excite in writing via e-mail or contact form, stating the error description and invoice number. Only when the excite Customer has confirmed the return with a return authorization number (RMA), the goods can be returned to the address indicated by excite. The products including all accessories and in its original packaging shall be packaged properly, and shipped including insurance.

In case of a return due to a defect of the product, a copy of the purchase invoice and an error description must be enclosed. Products that have no detectable error or defect and thus are not covered by the warranty, may be charged with the cost of testing and the return shipping to the customer.

11. Warranty

In general, a three-year warranty applies to all products starting from the date of delivery. In a case of warranty, excite shall furnish the choice to fulfill warranty obligations by repair, replacement or price reduction.

The right of warranty shall only be granted if no reasons for exclusion, such as normal wear and tear, damage due to incorrect operation, interventions and manipulations, as well as external factors such as natural hazard, moisture, fall and impact damages or similar, are present.

Goods marked as “refurbished” are demonstration products or returns. They might have slight visual defects or be restored products, which is why they are also sold at a reduced price. Optical defects are excluded from the warranty.

12. Repair after the Warranty Period

For repairs after the warranty period, excite may – at its own discretion – make free repairs (if it is a genuine warranty case) or charge costs for the repairs.

13. Liability

Compensation claims against excite and its auxiliaries, insofar as legally permissible, are fully excluded. The liability for indirect or direct damages arising from the use, misuse or failure of service is also excluded. This disclaimer also applies to all kinds of direct and indirect damages (ie both personal property and economic losses), caused by incorrect or unprofessional assembly, installation, adjustment, maintenance or repair of the product by the customer.

14. Privacy Statement

By the acceptance of the GTC, our privacy policy will be accepted automatically.

15. Jurisdiction and Applicable Laws

Place of Jurisdiction shall be in Zurich, Switzerland. The contract is subject to Swiss Law wherein UN Sales Law (CISG) is fully excluded.
